General conditions of lease

SUITABILITY: The captain has to be an adult and produce a document of identification at the moment of boarding. Furthermore he is in charge of the material handed out to him. DEPOSIT: It has be left on the day of departure at the moment of boarding in cash or by cheque. The deposit will be reimbursed at the end of the cruise provided that the equipment be returned in good condition at the agreed time and place. The amount of the deposit is equivalent to a damage waiver to compensate for possible damage and accidents. The sum may also be used for maintenance, and/or repair of motor, for maintenance of the boat or pther small expenses. On departure you will be told how to get your deposit reimbursed depending on duration of cruise and choice of the boat. CANCELLING OF CRUISE: In case you have to cancel your reservation, please notify immediately, in ink, h&p Shipyard via Vulpariolo Zona Porto Canale - 26100 Cremona. Tel. 0372 - 446112 Fax. 0372 - 447434, or send an e-mail to hp.shipyard@dinet.it <mailto:hp.shipyard@dinet.it The following percentages will be deducted if reasons for cancellation differ from the cancellation plan. 1) Cancellation earlier than six weeks prior to departure: 10% of the total of the reservation 2) Cancellation between four and six weeks prior to departure: 20% of the total of the reservation plus charge for paprework. 3) Cancellation later than four weeks prior to departure: 100% of the total cost of the reservation plus charge for paperwork. Notified by the hirer out: If due to unforeseen circumstances it is impassible to provide the hirer with the boat at the hirer's disposal which meets the hirers required specifications. If this is not possible the total amount of money paid at the moment of booking will be reimbursed. CANCELLATION-PLAN OF CRUISE: This plan guarantees the hirer the reimbursement of cancellation expenditure to be paid to the lessee by applyng the conditions of cancellation. This plan is valid in case the cancellation is made before departure and caused by the following: 1) Serious illness 2) Serious accident 3) Decease of a family-member or acquaitance 4) Heavy damage at one's home 5) Dismissal 6) Change of occupation The plan also covers all the members of the crew mentioned in the reservation document. INSURANCE: It is included in the price and comprises: Insurance of the boat and the hirer's liability against a third party in case of accident inside valuables and civil liability are not covered by insurance. ACCIDENTS: After an accident the hirer has to warn the lessee immediately. The latter will point out the procedure to follow and carry out all the necessary operations for assistance, but abstain from any non-urgent. The lessee undertakes to enter any injuries into the log book and get them signed for the injuries party. The hirer either cause or victim of the accident may not claim any indemnity for himself or the cruise in case he himself were involved. BOARDING/CHECKING-IN: The boat is at the hirer's disposal after check in (inventory of the material on board). The hirer has the right to refuse the boat if: 1) It does not correspond to the contract of lease at the moment of its stipulation 2) The equipment indispensable for cruising is not in good conditions or if hygenic conditions and tidyness on the boat are not in comformity with what the hirer may expect. boarding may be carried out in a place different from the one mentioned in the contract in case mooring is impossible in case of olood or other reasons which make boarding impossible. CHECKING-OUT: The boat has to be returned on the date, time and place stipulated in the contract, except for unforeseen events which are beyond the hirer's command. The boat has to be returned to the lessee same state as it was hired. The inventory-state of places agreed on departure has to be respected at expiry. The lessee the right to claim expenditure from the hirer for returning late or abandoning the boat during the cruise. DESCRIPTION OF BOATS: The plans are in conformity with the description of the boat. HOW TO USE THE BOAT: The hirer has to comply with the rules of river navigation as well as with instructions given by the lessee and river authority. The hirer may only sail in authorized zones comunicated by the lessee. It is forbidden to sail after sunset, during dusk, to two, hire or lend the boat.
